IANAL....
Basically you have to have a couple of things in place:
1) A written policy on usage
2) You have to make the employee aware of the policy
3) The employee has to acknowledge that they are aware of the policy and
that they have read it.
4) Acquire proof of policy breach.  For best results the breach should
be intentional not incidental.
5) Just-cause dismissal
